Terms and Conditions
Twilight photography is carried out from 30mins prior to sunset as listed on Google for that date, until 60mins following sunset.
Properties outside of the Gold Coast will incur a $50 travel fee.
All prices provided verbally or within our price list include GST and are subject to change.
We are not responsible for the presentation of the property being photographed, and the property will be photographed as it is presented.
Digital-decluttering is available as an additional service in the event the property is not well-presented. The client indemnifies us against any claims, damages or liabilities arising from the properties condition, legal disputes or unauthorised use of the photographs.
If photography cannot be carried out for any reason not our own (i.e. clutter or access issues), a $50 call-out fee (inc. GST) will be charged. If photography cannot be carried out due to unforeseen circumstances (natural disaster, illness, equipment failure) we may request to delay, reschedule or cancel the shoot and cannot be held liable to any inconvenience or financial damages incurred.
Cancellations must be made prior to our departure to carry out the arranged works. Failure to provide adequate notice of cancellation will incur a $50 cancellation fee.
If the photographer is instructed to carry out the job when the weather is inclement due to deadlines, we reserve the right to charge a fee if an additional visit to the property is requested for fine weather given that the photographer would otherwise be at a paying job in the time taken to reshoot your property. At all times we will endeavour to preserve the privacy and confidentiality of our clients and those they represent however the client acknowledges that we are not liable for any breaches in privacy that result from our works.
In the event that the services rendered do not fulfil desired expectations, a reshoot can be requested. A reshoot may or may not be covered at cost by us depending on the scope of the reshoot process and we reserve the right to deny a reshoot.
The client ensures we have legal and safe access to the property, including notifying the tenants, owner or occupier of our intention to access the property and for what purposes.
We retain the copyright of any images and marketing materials supplied by us, however, you are granted a license to use the images and marketing materials for the purpose of advertising the subject property for sale or rent. The licence may not be transferred to another agent, agency or business until we have provided permission in writing or the purchase of a limited license has been arranged. We do not usually require credit to be listed when publishing media provided by us however should we request it, it must be complied with.
The images and marketing materials supplied by us are not to be re-sold, leased, or provided to any other third parties (not including supply to the property owner as a memento) without our written permission.
Free edits or changes to the supplied content must be notified to us within 72-hours of photos being sent to client. Outside of this timeframe we reserve the right to charge an additional editing fee.
All content will be delivered digitally via Google Drive, Dropbox, WeTransfer or whatever medium the client specifies as preference.
We retain the right to use the images for purposes of marketing and promotion of the business and its services including on websites, printed materials, and social media platforms. We may resell the image rights to third parties.
We aim to provide images and marketing materials within 48-hours of the shoot concluding, however some services such as virtual staging and advanced digital decluttering will extend this duration wherein you will be provided an updated timeline.
Files are available for 30-days via the link provided. It is the responsibility of the client to download and save and back-up the files. We retain files for a maximum period of 3-months from shooting beyond which we cannot guarantee we will still possess them.
We may digitally enhance the images during the post-production process. This typically involves sky replacement, adjustments to brightness, colour correction, removal of clutter and enhancement of grass. The client accepts full responsively for any legal action, claims or damages resulting from this post-production process and any special requests made by the client or vendor. Client accepts full responsibility for any claims arising from digitally altered images and media.
Payment terms are outlined on the invoice which will be sent at the conclusion of the shoot. We require full payment to be made for new clients before any final material can be released. Invoices outstanding over 60-days and are considered overdue. Overdue invoices will incur an administration fee of $12 every week that they remain unpaid. If invoices remain unpaid after a period of 6-months, they may be referred to a collection agency. You will be informed of any overdue invoices before they incur additional fees or are escalated to a collection agency.
We will seek to resolve any dispute via clear and open communication. Should the need for mediation arise we can seek this through the Queensland Dispute Resolution Branch or via a private mediator.
